Commissions

If you have a problem with any of these terms, they may be changed if discussed with me prior to paying for your commissioned piece.

DEFINITIONS
Artist : The individual producing the Commission, ie "Kaito" "MidnightKaito" "Midnight Kaito"Client : The individual purchasing the Commission.Personal Usage : Any image or project to be commissioned that will not be used for profit of any kind.Commercial Purpose : Any image or project to be commissioned that is to be used to make a profit of any kind.Commission : The form of service provided by the Artist to the Client per the Artist Commission Agreement. “Commission,” “Art[work],” “Image[ry],” and “Project[s]” may be used interchangeably in Commission correspondence.Artist Commission Agreement : An agreement between the Artist and Client that documents the scope of the work, fees and payments, the expected deadline and delivery of the Commission, usage of the Commission, refunds, termination of service and anything else discussed prior to the first deposit and the signing of the agreement.Social Media : Online locations where the Commission may be displayed (e.g., “galleries," "albums," "posts," etc.). Social Media as defined herein does not include any website(s) that display hateful or racist imagery, illegal activities, or locations or organizations known to display, reproduce, and/or sell works without crediting the Artist.

GENERAL
By commissioning me you automatically agree to all of the following conditions unless otherwise specified.- I reserve the right to refuse an order that I do not feel comfortable drawing for any reason.- All drawings will include a subtle sign that you may not remove.- I might record the drawing process and post it on my YouTube.- Prices are subject to change based on demand.- If I have accepted, I will send you an invoice of the price and an "Artist Commission Agreement"
My work will not be used to train AI or be sold as an NFT/Crypto/Anything related to block-chain.- If you are requesting Fanart, it is for personal use ONLY. I am not legally responsible should you be found to be using anything you have commissioned from me for anything other than personal use-The base price of the selected commission(s) is a non-refundable deposit in the event that the client has cancelled unexpectedly once the work has started.- I reserve the right to refuse or cancel an order, with a full refund, with a prior warning in case of emergencies.- You may NOT use the commissioned artwork for commercial purposes.- The license to the commissioned artwork may be purchased at any point unless it is Fanart, at which point it is for PERSONAL USE ONLY - contact me for info.


USE/INTELLECTUAL PROPERTY RIGHTS
I claim the rights to the produced drawing, not the buyer.Therefore I am allowed to use the copyrighted artwork to:
- Promote myself with it everywhere- Display it everywhere to my liking- Post it wherever I wantThe buyer is allowed to:
- Use the commissioned piece for personal use only unless agreed otherwise (you can upload it on all your social media profiles, forums, etc.)- Print the artwork- Unless it is Fanart, claim the character(s) as their own, but not the artwork itself.- Post the artwork on social media, use the artwork to promote themselves, use as their avatar, decorate a webpage or banner, etc so long as credit is given- Use the artwork on their YouTube channel and in monetized videos as long as the artwork itself is not the main subject for the earnings.The following is considered copyright infringement:
- Reproducing/using the copyrighted artwork commercially - means making money off it in any way.- Claiming the artwork as your own- Removing my signature from the artworkAltering the artwork without my consentI reserve the full rights to the image and it's use/distribution unless otherwise agreed upon (rights to the image for your own non-personal use may be purchased at any time so long as it is not Fanart).


PAYMENTS
Commissions can be 50% upfront and 50% after the final commission is finishedDon't send me any payment before I have agreed and have sent you an "Artist Commission Agreement"


DEADLINES AND DELIVERY
- I will contact you within 7 days of your request whether I have accepted or declined the commission.- I will not start the artwork until the "Artist Commission Agreement" is sent back to me with a deposit of half the agreed price.- After I have received both half the deposit and the "Artist Commission Agreement" I will contact you via Discord and sit down with you on a call while streaming the initial stage of the drawing. Any revisions at this stage will not count unless they are very far off from the original commission.- 7 to 14 days from the stream I will give you a Work in Progress (WIP)The 2 WIPs sent will usually include a watermark, be at a lower resolution, and be smaller than the finished piece.- The time it takes to finish your commission varies between 1 week - 3 months depending on factors such as health, the complexity of the commissioned piece, other work and con seasons.- If anything comes up that will slow the progress of the initially estimated delivery time I will let you know ASAP.- Once the piece is finished you will receive the full-resolution image along with a web-friendly size. Note that there is no physical product.


REVISIONS
- I will send you 2 WIPs and allow up to 3 minor revisions. Past the 3 revisions, a fee will be added.- A fee will be added if you want something changed on the final drawing - unless a misunderstanding from my side has been made.- If you wish for me to change something in the drawing you have previously approved, I will charge you a fee to change it. The amount of the extra charge depends on the change you want me to make.


REFUNDS
- I reserve the right to refuse or cancel an order, with a full refund, with a prior warning in case of emergencies.- Refunds are only accepted if I have yet to finish the piece. Upon cancellation, I will charge what I have worked on.- Upon unexcepted cancellation, the deposit base price is forfeit- If you cancel your order before I start it, you can get a full refund.


WHAT DO YOU GET?
- Drafts/mockups that you must decide which one I should continue with (depending on the complexity of the commission there might be fewer or more drafts). This will usually be done on a private stream with me via Discord DM.- Sketch and/or final sketches that you must accept before I continue the workInsight and involvement in colour plan (depending on the complexity of the commissioned piece)- Full-resolution file (approx. 210 x 297 mm at 300 DPI) of final drawing and a smaller version for internet upload. Final file formats are usually PNG. If another is needed please inform me of it.


These terms and conditions are subject to revision without notice. The Client is responsible for reviewing and agreeing to the Terms of Service before entering into a Commission Agreement with the Artist. Once the Client enters into a Commission Agreement with the Artist, it is assumed the Client has agreed to all Terms of Service.
